What is Mediation?
Mediation is a means of dispute resolution where a mediator will facilitate the negotiations between the parties with a view to settling the difference. The mediator will manage the process of negotiations but will not impose a decision – the parties decide on whether or not there is a settlement and the terms of the settlement. If parties agree to settle, the settlement agreement becomes a contract between the parties which is legally binding.
How does Mediation work?
Mediation is confidential, voluntary, consensual and a “without prejudice” process. Firstly, confidentiality means that whatever information shared during mediation is private and should not be disclosed. Secondly, voluntary and consensual means that parties to the dispute have to agree to the mediation and cannot be forced to participate. Lastly, “without prejudice” means that if the matter is not resolved via mediation, parties are not prevented from pursuing other dispute resolution means such as litigation or arbitration.
Please note that for mediation to proceed, all parties have to be present. Parties who attend the mediation must have the authority to settle the dispute and sign the settlement agreement.
How much does Mediation cost?
Mediation fees are generally determined by the quantum in dispute.
Our Small Case Commercial Mediation Scheme (SCCMS) applies where the quantum in dispute is S$60,000 and below. Mediation under SCCMS is free for the first two hours and will be chargeable from the third hour, beginning from S$80.25 per hour.
